Florida-Based Cruise Line Sued for Alleged Slip and Fall

Jacksonville Personal Injury Lawyer.jpgCarnival Cruise Line has been sued for an alleged slip and fall aboard the cruise vessel "Carnival Victory." The plaintiff, Kristopher Williams brings a Negligence action for injuries sustained during Kristopher's August cruise. The Complaint stated that while the plaintiff was walking down flight of stairs, the plaintiff slipped and fell because of "a wet and slippery foreign substance."

This action is based on the legal theory of Negligence. To have a valid claim of negligence four things must be shown: (1) a duty by the defendant owed to the plaintiff, (2) a breach of said duty to plaintiff, (3) causation between the breach and injury, and (4) damages/ injury resulted.

The Complaint alleges that the Defendant, the Florida-based cruise line, owed the Plaintiff a duty to use reasonable care under the circumstances and that the Defendant breached that duty in several aspects by allowing a hazardous substance to remain on the steps. The Defendant knew or should have know about the dangerous condition that existed and because of this failure to maintain its premises, the Plaintiff suffered injures. Finally, as a direct and proximate result of the negligence of the cruise line, Kristopher suffered bodily injury.

The Complaint alleges compensatory damages, court costs, pain and suffering, lost wages, mental anguish, medical costs, and any other such relief the court deems appropriate.
